Welcome to Tiny Torquez.

The terms “Tiny Torquez”, “we”, “us” and “our” refer to Tiny Torquez. We operate this website and online store, including its content, features, products and related services (collectively, the “Services”). Our online store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with the policies referenced in them, explain your rights and responsibilities when accessing our website or purchasing from Tiny Torquez.

By visiting, browsing or using the Services, or by placing an order with us, you agree to these Terms and our Privacy Policy. If you do not agree, please do not access or use the Services.

Nothing in these Terms excludes, restricts or modifies any consumer right or remedy that cannot lawfully be excluded.

SECTION 1 — ELIGIBILITY AND ACCOUNTS

By using the Services, you confirm that you are at least the age of majority in your state, territory or country of residence. If you permit a minor to use a product purchased from us, you are responsible for ensuring appropriate adult supervision and safe use.

When using our Services or placing an order, you may be asked to provide information including your name, email address, billing details, payment information and shipping address. You agree to provide information that is accurate, current and complete.

You are responsible for protecting your account credentials and for activities conducted through your account. You must notify us promptly if you believe your account has been accessed without permission.

You may not sell, transfer, assign or license your customer account to another person.

SECTION 2 — PRODUCTS AND PRODUCT INFORMATION

Tiny Torquez sells miniature remote-control vehicles, machines, accessories and related products.

We make reasonable efforts to display product descriptions, specifications, colours, images, dimensions and other information accurately. However, colours and appearance may vary depending on your screen, lighting conditions, manufacturing batches and device settings.

Product dimensions and scale references are approximate unless expressly stated otherwise. Packaging, accessories and minor design details may vary where suppliers or manufacturers update a product without materially changing its function.

Product images may include props, scenery or accessories for demonstration purposes. Only the products and components expressly identified in the product description or “What’s in the box” section are included.

We may update product information, correct errors, limit quantities or discontinue products without prior notice. Any material change affecting an existing order will be communicated to the customer where reasonably possible.

SECTION 3 — PRODUCT SAFETY AND USE

Our products may contain small parts, rechargeable batteries, moving components and electrical parts. They must be used responsibly and in accordance with the supplied instructions.

Unless a product page expressly states otherwise:

• Products are not suitable for children under three years of age.

• Children should use products only with appropriate adult supervision.

• Products and batteries must be kept away from water, excessive heat, open flames and other hazardous conditions.

• Charging cables, batteries and controllers should be inspected before use.

• Products should not be modified, disassembled or charged using incompatible equipment.

• Damaged, swollen, leaking or unusually hot batteries must not be used or charged.

You are responsible for reviewing product information and determining whether a product is suitable for its intended user and purpose.

Tiny Torquez is not responsible for damage caused by misuse, unauthorised modification, failure to follow instructions or use outside the product’s intended purpose, except where liability cannot legally be excluded.

SECTION 4 — ORDERS

Submitting an order constitutes an offer to purchase from Tiny Torquez. An automated order confirmation acknowledges that we received your order but does not necessarily mean that it has been accepted.

An order is accepted after payment has been successfully processed and we confirm that the order can be fulfilled.

We reserve the right to decline or cancel an order where:

• A product is unavailable;

• Product, pricing or inventory information contains a material error;

• Payment cannot be authorised or appears fraudulent;

• The shipping address is incomplete, invalid or outside our supported delivery area;

• The order appears to be intended for unauthorised resale; or

• We reasonably believe the order violates these Terms.

If we cancel an order after payment has been taken, we will issue a refund to the original payment method.

Please review your order and shipping information carefully before submitting it. We may be unable to change or cancel an order once it enters fulfilment.

Purchases are subject to our Return and Refund Policy.

SECTION 5 — PRICES, DISCOUNTS AND PAYMENT

Unless otherwise stated, prices displayed on Tiny Torquez are in United States dollars (USD).

Prices, promotions and discounts may change without notice. The amount charged will be the price shown at checkout when your order is submitted.

Applicable taxes and any other charges will be displayed at checkout where required. Tiny Torquez currently offers free shipping to eligible United States delivery addresses unless otherwise stated during checkout.

Discount codes and promotional offers:

• Must be used within the stated promotional period;

• May be subject to minimum purchase requirements;

• Cannot be redeemed for cash;

• May not be combined unless expressly permitted; and

• May be withdrawn or corrected if published in error.

Bundle discounts apply only to qualifying products purchased together in accordance with the displayed offer. If part of a discounted bundle is returned, the refund may be recalculated to reflect the discount applicable to the products retained, to the extent permitted by law.

You agree to provide accurate billing and payment information and confirm that you are authorised to use the selected payment method.

SECTION 6 — SHIPPING AND DELIVERY

Tiny Torquez currently ships to eligible addresses within the United States.

Estimated delivery timeframes are provided in our Shipping Policy and during the purchase journey. Delivery estimates are not guarantees and may be affected by carrier delays, customs processing, weather, public holidays, high order volumes or other circumstances outside our reasonable control.

Products may be fulfilled by third-party logistics partners and may ship from different fulfilment locations. Orders containing multiple products may arrive in separate packages.

Customers are responsible for providing a complete and accurate shipping address. Additional costs caused by an incorrect or incomplete address may be charged to the customer where permitted by law.

An order is not considered delivered solely because it has been transferred to a shipping carrier. If tracking indicates that an order is lost, delivered to the wrong address or otherwise not received, contact us at contact@tinytorquez.com so we can investigate.

If tracking shows delivery to the address supplied at checkout but you cannot locate the parcel, please check with household members, neighbours and the carrier before contacting us.

SECTION 7 — RETURNS, REFUNDS AND CANCELLATIONS

Returns and refunds are governed by our Return and Refund Policy, which forms part of these Terms.

We offer a 30-day return period beginning on the date an eligible product is delivered.

Customers must contact us and receive return instructions before sending an item back. Products returned without prior approval, or sent to an address shown on the original parcel without confirmation from us, may not be accepted.

For change-of-mind returns, customers are responsible for return shipping costs. If an item arrives damaged, defective or incorrect, we will assess the issue and provide an appropriate remedy.

Order cancellation requests should be submitted as soon as possible. We cannot guarantee cancellation once an order has entered fulfilment or has been shipped.

Nothing in this section limits any right or remedy that cannot lawfully be excluded.

SECTION 8 — INTELLECTUAL PROPERTY

The Services and their content—including Tiny Torquez branding, logos, text, graphics, page designs, photographs, videos and original promotional materials—are owned by or licensed to Tiny Torquez and are protected by applicable intellectual property laws.

You may access and use the Services for personal, non-commercial shopping purposes only.

Without prior written permission, you must not:

• Copy, reproduce, distribute or republish our content;

• Modify or create derivative works from our content;

• Use our branding, logos or product imagery for commercial purposes;

• Extract or reuse substantial parts of the website;

• Misrepresent an affiliation with or endorsement by Tiny Torquez; or

Third-party trademarks, product names and logos remain the property of their respective owners.

Questions or disputes concerning products or services purchased directly from a third party should be directed to that third party.

SECTION 11 — RELATIONSHIP WITH SHOPIFY

Tiny Torquez is powered by Shopify, which provides the ecommerce platform used to offer the Services.

Purchases made through our store are transactions directly between you and Tiny Torquez. Shopify is not the seller of Tiny Torquez products and is not responsible for fulfilling orders, providing customer service or resolving product-related issues.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims arising solely from a purchase or transaction between you and Tiny Torquez.

SECTION 12 — PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our store is hosted by Shopify, Shopify processes certain information about your access to and use of the Services. Shopify’s handling of personal information is described in its Privacy Policy.

Information may also be processed by payment providers, fulfilment partners, analytics providers and other service providers necessary to operate the store and fulfil orders.

SECTION 13 — REVIEWS, FEEDBACK AND USER CONTENT

If you submit a review, image, video, suggestion, comment or other content to Tiny Torquez (“User Content”), you confirm that:

• You created it or have permission to submit it;

• It is truthful and based on your genuine experience where presented as a review;

• It does not infringe another person’s rights;

• It does not contain unlawful, abusive, misleading or malicious material; and

• Any incentive or compensation connected with the submission has been disclosed.

You grant Tiny Torquez a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, adapt and display submitted User Content for operating and promoting our business.

We may moderate or remove content that violates these Terms, but we are not required to publish, retain or respond to every submission.

SECTION 14 — ERRORS AND INACCURACIES

Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, shipping charges, delivery estimates or availability.

We may correct errors and update information when identified. If a material error affects an order already placed, we will contact you where reasonably possible and provide an appropriate option, such as confirming the corrected order or receiving a refund.

Nothing in this section permits Tiny Torquez to avoid obligations that cannot lawfully be excluded.

We may suspend or terminate access to the Services if you materially breach these Terms, engage in fraudulent or unlawful activity, threaten the security of the Services or misuse our systems.

Termination does not affect rights or obligations that arose before termination. Provisions that are intended by their nature to survive termination will continue to apply.

SECTION 17 — CONSUMER GUARANTEES AND WARRANTIES

Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, right or remedy that cannot lawfully be excluded under applicable consumer protection law.

Where the Australian Consumer Law applies, our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Subject to these non-excludable rights, the website and its general informational content are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, secure or free from technical errors.

SECTION 18 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, Tiny Torquez will not be liable for indirect, incidental, special or consequential losses arising from use of the Services where such losses were not reasonably foreseeable.

Nothing in these Terms excludes or limits liability for:

• Fraud or fraudulent misrepresentation;

• Death or personal injury caused by negligence where liability cannot be excluded;

• Any other liability that cannot lawfully be excluded or limited.

Where our liability can lawfully be limited, it will be limited to the remedies available under applicable law.

SECTION 19 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify Tiny Torquez and its officers, employees, contractors and service providers against third-party claims arising directly from:

• Your material breach of these Terms;

• Your unlawful use of the Services;

• Your infringement of another party’s rights; or

• User Content submitted by you that violates these Terms.

This section does not require you to indemnify Tiny Torquez for losses caused by our own negligence, unlawful conduct or breach of these Terms.

SECTION 20 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted or severed where necessary.

The remaining provisions will continue in full force and effect.

SECTION 21 — WAIVER AND ENTIRE AGREEMENT

A failure or delay by Tiny Torquez to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms and the policies incorporated by reference constitute the agreement between you and Tiny Torquez regarding use of the Services and supersede earlier communications concerning the same subject matter.

Nothing in this section excludes representations or rights that cannot lawfully be excluded.

SECTION 22 — ASSIGNMENT

You may not assign your rights or obligations under these Terms without our prior written consent.

We may assign our rights and obligations as part of a sale, transfer, restructuring or other legitimate business transaction, subject to applicable law.

SECTION 23 — GOVERNING LAW

These Terms are governed by the laws of Queensland, Australia and the applicable laws of the Commonwealth of Australia.

You and Tiny Torquez submit to the non-exclusive jurisdiction of the courts of Queensland and any courts entitled to hear appeals from them.

This section does not prevent a customer from exercising rights available under mandatory consumer laws that apply in the customer’s place of residence.

SECTION 24 — CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes to our Services, business practices or legal obligations.

The current version will be published on this page with its effective date. If a change materially affects your rights, we will provide notice where required by applicable law.

Changes will not retrospectively alter the terms applying to an order already accepted unless required by law or agreed with you.
